DPCC stands for Delhi pollution control committee which is a body which makes sure that industries/businesses are working within the regulated limits of pollution/combustion levels in the state of Delhi and Provide No Objection certificate to every business according to their category based on the level of pollutant an industry/establishment releases, these NOC (no objection certificate) comes in two steps namely CTE/CTO i.e. Consent to Establish and Consent to Operate.

Objective of DPCC
CTE - Consent to establish is NOC given by DPCC which is required before you start your business or enterprise as per The Water (Prevention & Control of Pollution) Act – 1974 and the air (prevention and control of pollution) act, 1981. It is mandatory to obtain CTE from the respective State Pollution Control Board (DPCC) before the commencement of business. The Process requires the application in prescribed format along with required documents and fees followed by Inspection.
CTE- सहमति स्थापित करने के लिए DPCC द्वारा दी गई NOC है जो आपको जल अधिनियम 1974 और वायु अधिनियम 1981 के अनुसार अपना व्यवसाय या उद्यम शुरू करने से पहले आवश्यक है। व्यवसाय शुरू होने से पहले संबंधित राज्य प्रदूषण नियंत्रण बोर्ड (DPCC) से CTE प्राप्त करना अनिवार्य है । प्रक्रिया को आवश्यक दस्तावेजों और निरीक्षण के बाद फीस के साथ निर्धारित प्रारूप में आवेदन की आवश्यकता होती है।
CTO- Consent to operate as it is known is NOC given by State pollution control board (DPCC) to operate your business after you have received your CTE NOC from SPCB(DPCC) as per The Water (Prevention & Control of Pollution) Act – 1974 and the air (prevention and control of pollution) act, 1981. The procedure involves the filing of the respective application in the prescribed format, documents and fees for the application followed by inspection and after this process CTO is issued.

Validity of License
CTE remains valid for 1 year from the date of grant of a license
CTO in green category remains valid for 10 years from the date of grant of a license
CTO in Orange category remain valid for 5 years from the date of grant of a license
The Delhi Pollution Control Committee shall grant the Pollution Control No Objection Certificate (NOC) the industries which are permissible in the mixed land use areas or zones as per by-laws of the Master Plan notified by the NCT of Delhi or the draft master plan.
Any industry or enterprise established in the designated or approved area(s).
दिल्ली प्रदूषण नियंत्रण समिति अधिसूचित मास्टर प्लान या ड्राफ्ट मास्टर प्लान के उपनियमों के अनुसार मिश्रित भू उपयोग क्षेत्रों या क्षेत्रों में अनुमत उद्योगों को प्रदूषण नियंत्रण अनापत्ति प्रमाणपत्र (एनओसी) प्रदान करेगी।

Establishment of any industry is not allowed in any of the approved residential areas of Delhi and no red or orange category of industry shall be given consent to establish by state pollution control board within the Municipal Corporation limits of NCT of Delhi except in the designated industrial area/zone.
Any industry which is established at any area other than the designated or approved area / zone shall not be granted the Pollution Control NOC by the Delhi Pollution State Committee.

Post filing of the application the same is scrutinised by the authorised officers of the DPCC.

What are the different types of Consent or NOC prescribed by DPCC?
There are 2 types of Consent prescribed by DPCC which shall be obtained by any business situated in Delhi which generates any form of pollution:
1. Consent to Establish (CTE): CTE is the permission to establish the business unit or industry granted by DPCC. This consent is granted as per the categories prescribed by DPCC. This permission is ideally required before even starting the business and prior to CTO.
2. Consent to Operate (CTO): Once CTE is issued the business owner shall apply for the consent to do business or the consent to operate in Delhi. This permission is put in place to regularise and govern the levels of pollution generated by the industries in Delhi.

What are the Permissions/ Clearances required?
Every business or industry established in Delhi which generates any type of pollution shall obtain pollution authorisation or NOC’s as per the categories prescribed by DPCC.
1. Pollution Consent or No Objection Certificate (NOC) is to be obtained from the Delhi Pollution Control Committee in the following cases:
> Prior to the establishment and commencement of the business unit.
> If an industry or business unit needs to have a system of Water and Affecting Effluent Disposal
2. Environmental Impact Assessment (EIA) is to be filed with and approved from the respective Pollution authority Department for any industries categorised highly polluting.
3. Prior permissions are to be obtained from the Municipality, Municipal Corporation or Panchayat for any industries operating outside the nominated Industrial Areas.
4. Approvals/licence from Chief Inspector of Boiler is to be obtained for any business units business unit which uses Boiler.
5. A NOC of the Development Commissioner of EPZ (Export Processing Zone) is to be obtained for business registered as100% Export Oriented Unit (EOU).

The Pollution Control Committees and Pollution Control Boards established by the MOEF (The Ministry of Environment, Forest and Climate Change) have prescribed the laws, statutes, rules and guidelines to regulate the pollution and protect the environment. What is the Procedure for obtaining Pollution NOC / Pollution Consent / Consent to Establish or Consent to Operate?
Step 1:Drafts are to be prepared along with the prescribed application form on the respective portal of the pollution control authority.
Step 2:The drafts and applications prepared shall be submitted online with the respective pollution control authority along with the prescribed fees.
Step 3:The submitted application is subject to applicable inspection and meticulous scrutiny by the designated officer. Post which the application is approved, reject or additional information is requested.
Step 4:The application is approved or rejected in accordance with the information submitted by the applicant and shall be approved or rejected in accordance with the provisions of the law.
